Defines the rules, responsibilities, and acceptable use of BharatFMS software and services.

Terms of Service

1. Service Overview

We provide a multi-tenant SaaS platform that enables franchise owners to manage centers, students, exams, certificates, and verification processes. The software may operate on client-specific domains.

2. Account & Tenant Responsibility

Each client operates as an independent tenant
Clients are responsible for managing users and access
Account credentials must be kept secure

3. Subscription Plans & Tokens

Our platform operates on annual subscription plans:

Silver, Gold, Diamond, and Unlimited plans
Each plan includes predefined token limits (except Unlimited)
Additional tokens are chargeable as per plan

Tokens are consumed based on system usage (e.g., operations, certificates, exams).

4. Token Policy

Tokens are valid only during active subscription
Unused tokens expire after subscription ends
Carry forward is applicable **only for Diamond plan**, and only on renewal or upgrade

5. Domain Benefits

Silver: No domain included
Gold & Diamond: 1 free **.in domain** (1 year)
Unlimited: 1 free **.in or .com domain** (1 year)

After 1 year, renewal charges apply and are the client’s responsibility.

6. Domain Responsibility

Clients are responsible for:

Domain renewal
DNS configuration (unless managed by us)
Compliance with domain registrar policies

7. Acceptable Use

Users must not:

Use the platform for illegal activities
Attempt unauthorized access
Disrupt system performance

8. Payments & Billing

Subscription is prepaid
No refunds unless explicitly stated
Non-payment may result in suspension

9. Service Availability

We aim for high uptime but do not guarantee uninterrupted service. Maintenance and third-party failures may cause downtime.

10. Data Ownership

Client retains full ownership of their data
We act only as a processor

11. Termination

We may suspend or terminate accounts for violations or non-payment.

12. Limitation of Liability

We are not liable for indirect or consequential damages, including data loss or domain issues.

13. Governing Law

These terms are governed by Indian law.

Refund & Cancellation Policy

1. Cancellation

Clients may cancel subscription anytime. Access continues until expiry.

2. Refund Policy

All payments are non-refundable
No refunds for unused tokens or partial usage

3. Exceptions

Refunds may be considered only if explicitly agreed in writing.

4. Plan Changes

Upgrades allowed anytime
Downgrades apply only at next billing cycle
